Was Your Termination Wrongful?
Wrongful termination is a term that usually refers to a person being fired for unlawful reasons. It can be misleading in that many firings that people think are "wrongful" may not necessarily be illegal. In California an employer can terminate an employee for almost any reason or for no reason at all. They cannot, however, fire you because:
- You belong to a protected class i.e., because of your race, gender, age, national origin, religion or disability
- You blew the whistle on your employer's illegal activity to the employer or to an outside agency
- You file a worker's compensation claim
- You reported sexual harassment or discrimination
- You took your protected family leave
- You reported your employer's failure to provide reasonable accommodations
- You reported your employer's failure to pay overtime or other wage and payment issues
An employee that has a contract with the employer most likely cannot be terminated without just cause. Most union members work under such a contract which may be either express or implied.
Other than these exceptions and a few others, employers can fire employees for any reason, even because they just don't like the employee.
